Health Information Privacy Legislation of Ontario Exemption OrderHRinfodesk---Canadian Payroll and Employment Law, February 2005 Based on the recommendations of the Minister of Industry, the Canadian Governor in Council is proposing to declare the Ontario Personal Health Information Protection Act, (PHIPA) substantially similar to the federal Personal Information Protection and Electronic Documents Act (PIPEDA).The Order proposes to exempt health information custodians subject to PHIPA from the federal Act, in respect of the collection, use or disclosure of personal health information that takes place within the province. PIPEDA will continue to apply to the activities of federal works undertakings or businesses and to the collection, use or disclosure of personal information outside the province, in the course of commercial activity. Notice of the proposed Order was published in Part 1 of the Canada Gazette on February 5, 2005.
